There has been a considerable shift from looking at S.91(14) orders as so-called “barring orders” to viewing them more as a “protective filter”. This presentation covers the evolution of how courts and practitioners approach S.91(14) orders and how we should be using them now following the advent of the Domestic Abuse Act 2021 and recent case law changes.
The two most important cases, Re P and Re A, are analysed in conjunction with relevant guidance from statute, other case law and the Family Procedure Rules 2010.
