This Bite sized 30-minute webinar will deal with the updated and revised Home Detention Curfew Scheme. It was Statutory Instrument 2024 No. 755 which altered the position with effect from the 17th June 2024 by abolishing the ‘4-year rule’. The new position is that most prisoners serving a Standard Determinate Sentence of 3 months or more are eligible for consideration of early release under the scheme. Certain offenders are barred by statute from entering the scheme. There is also a presumption that other offenders are unsuitable because of their offence or because of their past history. The revised scheme will be looked at in the context of the government’s recent pronouncement that we shall have SDS40 whereby release from a Standard Determinate Sentence will ordinarily be at the 40% stage rather than the half-way point.

  • The maths – how it works where an offender has been given a 3-month sentence or a 4- month sentence or a 12-month sentence or 4 years or 6 years
  • Those offenders who are barred from entering the scheme by statute
  • Those offenders who are ‘presumed unsuitable’ unless there are Exceptional Circumstances whereby they should be permitted to enter the scheme
