Lexham Securities v Earlsford Capital Partners [2023] EWHC 909 (Ch) – short-term injunction granted to mortgagor restraining receivers from completing the sale of property, to give opportunity to redeem the mortgage.
McDonagh v Reeve [2023] EWHC 933 (Ch) – Restrictive covenant precluding “additional buildings” did not prevent demolition and replacement of existing dwelling-house, or restrict the size of the replacement.
Weaver v Smith [2023] EWHC 1200 (Ch) – Correct construction of deed meant that right of way extended to connect with public highway, instead of stopping several metres short.
